Debt Negotiation

Debt Negotiation is a legal process whereby attorneys use specialized techniques to dispute the validity of a specific debt by auditing the lending and collection practices of banks, credit card companies and debt collectors. The ultimate goal is for the Attorneys to negotiate with the creditors to achieve an agressive settlement of the debt for something less than the full amount.

Every consumer has specific rights as granted by the Fair Credit Billing Act, the Fair Debt Collection Practices Act, and the Fair Credit Reporting Act. In many cases lending institutions and debt collectors knowingly violate the consumer rights outlined in these various Federal Acts in an effort to increase profits. Such violations may reveal themselves in ambiguous fees and interest calculations affecting a consumer’s bill, or in the aggressive debt collection practices being employed to collect on a consumer’s debt. These are just a few examples.

The attorneys will review each client’s statements to ensure that they are being billed correctly according to the terms and calculations specified in the original lending contract. Any and all violations identified by the attorneys will be acted upon on the consumer’s behalf as part of the debt settlement process. As violations are identified, the attorneys will challenge them, often resulting in the removal of inappropriate charges from their client’s statements, and therefore a reduction in the total amount of debt owed.

In addition, the attorneys will evaluate the debt collection methods being employed by the client’s creditors to ensure that such methods are not in violation of the Fair Debt Collection Practices Act. As violations are identified, the attorneys take action on their client’s behalf.

Credit Restoration

According to the Fair Credit Billing Act a creditor may not report negatively on a consumer's credit report in relation to a debt that is in dispute. If negative notations are reported by the creditor in relation to a debt that has been submitted into the debt settlement service, such notations are in direct violation of the Fair Credit Billing Act and the attorneys will use such violations as negotiating leverage in an attempt to achieve an agressive settlement on the consumer's behalf. In addition, the attorneys will take various actions to address the violations in an attempt to have them removed from the consumer's credit report.
